BALAYOGI WRI T PETI TI ON No. 10890 of 2017 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) The petitioner is the applicant in O.A.No.593 of 2017 on the file of the Andhra Pradesh Administrative Tribunal, Hyderabad. His grievance was that the authorities have not disposed of his appeals/representations dated 29.11.2016 and 17.02.2017 in the context of the seniority in the cadre of Executive Engineers. By order dated 08.03.2017, the Tribunal opined that the authorities have upto one year to dispose of the appeals in terms of Rule 26 of the Andhra Pradesh State and Subordinate Service Rules, 1996, and dismissed the O.A.
Though the outer limit fixed by the aforestated Rule for disposal of appeals is one year, it does not mean that the authorities are expected to sleep over or keep such appeals pending upto the expiry of one year period.
In matters of seniority, appeals/representations require consideration immediately so as to obviate heartburn and complications arising out of further promotions.
The writ petition is accordingly disposed of directing the authorities concerned to consider the petitioner's appeals/representations dated 29.11.2016 and 17.02.2016 on their own merits and in accordance with law expeditiously and, in any event, not later than eight weeks from the date of receipt of a copy of this order.
