Heard learned counsel for the petitioner and the learned Government Pleader for Mines and Geology.

Show cause notice, bearing No.4919/VG/2010, dated 20.03.2018, issued by the Deputy Director of Mines & Geology, Visakhapatnam-second respondent herein, asking the petitioner herein to show cause as to why action should not be initiated for realisation of an amount of Rs.32,05,608/- as per Section 21 (5) of the Mines and Minerals (Development) Act, 1957, is under challenge in the present Writ Petition.

According to the learned counsel for the petitioner, in response to the said show cause notice, petitioner herein submitted an explanation on 04.04.2018, and the same is pending consideration before the second respondent. Since the impugned notice is only a show cause notice and as the petitioner herein already filed his explanation, in response to the same, this Court deems it appropriate to dispose of the Writ Petition with a direction to the second respondent herein to consider the said explanation, dated 04.04.2018, offered by the petitioner herein, and pass appropriate orders, strictly in accordance with law.

Accordingly, Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous petitions pending, if any, shall stand closed.
