..... Petitioner And The State of Telangana, rep. by its Principal Secretary (Civil Supplies), Secretariat, Hyderabad & others.
.....Respondents The Court made the following:
- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.28893 OF 2019 ORDER :
Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies for respondents. 2.
Petitioner is a fair price shop dealer, bearing Shop No.369, Misrigunj, Hyderabad. By the order impugned, the authorization of dealership of petitioner was suspended, for the reasons mentioned therein.
3.
Learned counsel for the petitioner, sought to contend that the suspension of authorization was erroneously made; that the inspection was not properly conducted and that petitioner has been operating the fair price shop for almost 39 years and at no point of time, any such allegation was made.
4.
It is not in dispute that the District Civil Supply Officer is competent to take disciplinary action against the fair price shop dealer including placing the fair price shop dealer's authorization under suspension. Against the said decision, remedy of appeal is available. The contentions urged by learned counsel for the petitioner being on merits, it is always open to the petitioner to raise those contentions before the appellate authority. Since petitioner has effective and efficacious remedy of appeal, this Court is not inclined to entertain the writ petition. 5.
Thus, granting liberty to the petitioner to prefer appeal, the Writ Petition is dismissed. If such appeal is preferred, the same
- 3 - shall be considered within eight weeks from the date of receipt of appeal. Pending miscellaneous petitions, if any, shall stand closed. __________________ P.NAVEEN RAO,J 30th December, 2019 Rds
