THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.20099 of 2016 ORDER:
The petitioner was appointed as Junior Assistant in the first respondent Company on 19.04.2000. He was promoted as Senior Assistant in the year 2008. While in service he completed Diploma in Civil Engineering in the year 2011. When the respondents were filling up the vacancies of Sub-Engineers on transfer he applied for the said post. He submitted a representation on 04.06.2013 when his case was not considered, but his junior's case was considered. Ultimately an order was passed on 09.05.2016 by the first respondent to consider the case of the petitioner and on the same, the second respondent passed an order on 11.05.2016 appointing him as Sub-Engineer on transfer and posted at Penagalur.
After receiving the said order, the petitioner was relieved from the present station at Rajampet and when he was about to report to duty he was informed that his appointment as Sub-Engineer was kept in abeyance in pursuance of the oral orders received by the second respondent over phone. Challenging the order dated 11.05.2016 keeping the earlier order in abeyance, the present Writ Petition is filed. Even after adjourning the matter on three occasions, no instructions have been received by the learned Standing Counsel for the respondents.
In the absence of instructions, it has to be assumed that there is no substantial reason for keeping the orders of appointing the petitioner as Sub-Engineer on 11.05.2016 in abeyance.
In the circumstances, the order in Memo No.SE/O/KDP/ PO/Adm/C1/F.9ABT/D.No.1262/16, dated 11.05.2016, is set aside and the respondents are directed to allow the petitioner to join the post of Sub-Engineer pursuant to the order in Memo No.SE/O/KDP/Adm/PO/C1/F.9(ABT)/D.No.1261/16, dated 11.05.2016.
The Writ Petition is, accordingly, allowed. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
