THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CRIMINAL PETITION No.5806 of 2017 ORDER:
This petition is filed under Section 482 Cr.P.C challenging the inaction on the part of the Additional Junior Civil Judgecum-Judicial Magistrate of I Class, Bapatla in disposing of the Crl.M.P.No.71 of 2015 in C.C.No.174 of 2009.
Heard the learned counsel for the petitioner and the learned Public Prosecutor representing the State of Andhra Pradesh.
A perusal of the record reveals that the petitioner is facing trial in C.C.No.174 of 2009 on the file of the Court of the Additional Junior Civil Judge-cum-Judicial Magistrate of I Class, Bapatla. The petitioner filed Crl.M.P.No.71 of 2015 under section 239 Cr.P.C. seeking discharge. For one reason or the other, the trial Court has not disposed of that petition so far.
Having regard to the facts and circumstances of the case, the learned Additional Junior Civil Judge-cum-Judicial Magistrate of I Class, Bapatla is hereby directed to dispose of Crl.M.P.No.71 of 2015 in C.C.No.174 of 2009 as expeditiously as possible, preferably, within a period of two months from the date of receipt of a copy of this order.
With the above observations, this Criminal Petition is disposed of. As a sequel, the miscellaneous petitions, pending if any in this Criminal Petition, shall stand closed. ___________________________ T. SUNIL CHOWDARY, J.
