THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR Writ Petition No.4456 of 2015 Order: (per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) After hearing the learned counsel for the parties, we dispose of the writ petition by the following orders: Learned counsel for the writ petitioner submits that his client will pay the tax dues. However, he says that his client has already paid the tax for certain period and his client is in a position to pay the same.
Under the circumstances, the writ petitioner shall approach the third respondent at an early date and produce the documents regarding payment of tax. The said Authority after considering the documents will work out the amount of tax due and payable and on such assessment being made, the petitioner shall pay the entire amount so to be calculated and on payment of the entire tax dues so to be ascertained, the vehicle shall be released forthwith. The writ petition is accordingly disposed of. Consequently, pending miscellaneous applications shall also stand closed. No order as to costs.
