- 2 - HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.28884 OF 2019 ORDER :

Heard learned counsel for the petitioners, learned Government Pleader for respondent No.1 and Sri V.Satyam Reddy, learned Standing counsel for respondent No.2. 2.

According to petitioners, though building permission was granted to them on 18.09.2019 to construct ground + one upper floor, the respondent Municipal Corporation is interfering in the construction activity, causing hardship to the petitioners. Hence, this writ petition is filed seeking direction to the 2nd respondentMunicipal Corporation not to interfere with the construction activity.

Learned Standing counsel, obtained written instructions from the Commissioner, Municipal Corporation, Karimnagar, dated 30.12.2019. Based on the written instructions, he would submit that the Municipal Corporation is not interfering with the physical possession of petitioners and not making any obstructions to the work.

In view thereof, there is no subsisting grievance to the petitioners. However, it is needless to observe that petitioners are entitled to undertake construction as long as the building permission granted to them subsists and petitioners do not deviate from the building permission granted to them. However, as and when, the deviations are noticed by the Municipal Corporation, it is entitled to take action, as warranted by law.
