HON'BLE SRI JUSTICE P.NAVEEN RAO ORDER:
The petitioner is a Sarpanch of Petlurivaripalem Grampanchayat, Narasaraopet Mandal, Guntur District. Alleging committing several illegalities, the District Panchayat Officer, Guntur District (2nd respondent) issued show cause notice on 02.04.2015 calling upon the petitioner to submit his explanation. Pending finalization of the issue, the District Panchayat Officer also passed orders withdrawing the cheque power of the petitioner. Aggrieved thereby, this writ petition is filed.
2. Learned counsel for the petitioner contends that in response to the show cause notice, dated 02.04.2015, the petitioner has submitted detailed explanation. On consideration of the explanation, the Divisional Panchayat Officer, Narasaraopet, Guntur District (4th respondent) submitted a report to the District Panchayat Officer, Guntur District (3rd respondent) on 11.05.2015. The Divisional Panchayat Officer has suggested to withdraw the allegation of lapses committed by petitioner by cautioning the Sarpanch. Learned counsel for the petitioner contends that even though such a report was submitted on 11.05.2015, so far no final decision is taken and the issue is kept pending for no valid reason.
3. Having regard to the submissions made, the Writ
Petition is disposed of directing the District Panchayat Officer, Guntur District (3rd respondent) to finalize the issue in consequent to the show cause notice, dated 02.04.2015, duly considering the report submitted by the Divisional Panchayat Officer, Narasaraopet, Guntur District (4th respondent), dated 11.05.2015, as expeditiously as possible, preferably within a period of four (4) weeks from the date of receipt of a copy of this order. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
