THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY Civil Revision Petition No.2257 of 2017 ORDER:

This revision petition is filed under Article 227 of the Constitution of India challenging the docket order dated 11.04.2017 in I.A.No.306 of 2017 in A.S.No.45 of 2017 on the file of the Court of IX Additional Chief Judge, City Civil Court, at Hyderabad. Heard both the counsel and perused the material available on record.

Learned counsel for the petitioner across the bar submitted that the petitioner is ready and willing to deposit an amount of Rs.2,50,000/ - to the credit of O.S.No.636 of 2015 on the file of the IX Junior Civil Judge, City Civil Court, Hyderabad. Learned counsel for the respondent in all fairness agreed for the same. In view of the submissions made by both the counsel, the petitioner is hereby directed to deposit an amount of Rs.2,50,000/ - (Rupees two lakhs and fifty thousand only) on or before 28.04.2017 to the credit of O.S.No.636 of 2015 on the file of the Court of IX Junior Civil Judge, City Civil Court, Hyderabad. Failing which, the respondent is at liberty to proceed in accordance with law. On such deposit, the respondent is permitted to withdraw the deposited amount subject to out come of the appeal without furnishing any security. The petitioner is further directed to pay the monthly rent on or before 10th of every succeeding month commencing from June 2017. There shall be interim stay of all further proceedings in

O.S.No.636 of 2015 on the file of the court of IX Junior Civil Judge, City Civil Court, Hyderabad, up to 30.09.2017. The learned IX Additional Chief Judge, City Civil Court, Hyderabad, is hereby directed to dispose of the appeal on or before 30.09.2017. With the above direction, the Civil Revision Petition is disposed of. As a sequel, the miscellaneous petitions, pending if any, shall stand closed.
