HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.8897 of 2016 ORDER:

Inaction on the part of respondents 1 to 5 from stalling the 6th respondent in making unauthorized constructions in Sy.No.464/A of Shankulapally village, H/o of Thippannapet Village, Jagtial Mandal, Karimnagar District is challenged in the present Writ Petition.

The grievance of the petitioner is that despite the complaint made by him about the unauthorized constructions made by the sixth respondent in the land in question, no action has been taken by the official respondents. The petitioner further placed on record the communication issued by the Panchayat Secretary, where in it is stated that no permission

has been granted in favour of the 6th respondent for making constructions in the land in question.

The learned Standing Counsel for the 5th respondentGram Panchayat submits that efforts are being made by the Gram Panchayat to serve notice personally and on refusal by the sixth respondent, the same has been affixed on the door in terms of the Panchayat Raj Act and Rules made thereunder. In otherwords, it is the case of the learned Standing Counsel that as on the date, the fifth respondent is acting upon the complaint made by the petitioner.

Inasmuch as the fifth respondent is acting upon the complaint, the grievance of the petitioner has been redressed. However, respondents 1 to 5 are directed to take immediate remedial steps and complete the entire process in accordance with law.

Subject to the above, the Writ Petition is disposed of at the admission stage.

Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
