THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY SECOND APPEAL No.1070 OF 2013 JUDGMENT:

This Second Appeal is filed under Section 100 of C.P.C. by the first defendant assailing the judgment and decree dated 21.10.2009 passed in A.S.No.10 of 2007 on the file of the Court of the IV Additional District Judge, East Godavari at Kakinada, wherein and whereby the judgment and decree dated 13.11.2006 passed in O.S.No.31 of 1990 on the file of the Court of the Senior Civil Judge, Peddapuram, decreeing the suit filed by the plaintiff for specific performance, was confirmed.

Learned counsel for the appellant submitted that during pendency of the appeal, the parties have settled the matter out of the Court.

In view of the submission made by the learned counsel for the appellant, no further orders are necessary in this appeal. Hence, the Second Appeal is closed. There shall be no order as to costs.

Consequently, Miscellaneous Petitions, if any, pending in this Second Appeal shall stand closed.
