THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.17776 of 2015 ORDER:

The petitioner is a Graduate in law and belongs to BC-A community. When a notification was issued for appointment to the post of Legal-cum-Probation Officer, she applied to the same. She was appointed vide proceedings, dated 30.06.2011, of the 3rd respondent and Letter of Contract was executed for a period of 12 months and it was extended from time to time. The last such extension was executed on 31.03.2015. While so, when the order of termination was passed on 20.04.2015, the present Writ Petition is filed challenging the said proceedings.

A counter affidavit is filed stating that though the Project Director sought permission for continuation of post from 01.04.2015 to 31.03.2016, in view of no orders of the District Collector, based on poor performance of the petitioner, the petitioner was paid one month payment i.e., for the month of April, 2015 in lieu of notice pursuant to clause 2 of Letter of Contract and her services were not continued.

3. The petitioner was appointed initially for a period of 12 months, which was extended from time to time upto 31.03.2015. This Court is not inclined to interfere with the impugned order as the services of the petitioner were not extended after expiry of the period of contract on 31.03.2015. Since the appointment of the petitioner is on contract basis, in the absence of existence of any contract, this Court cannot direct the respondents to continue the petitioner in service. However, this order will not prevent the respondents from re-engaging the services of the petitioner if she approaches for the same.

4. With the above observation, the Writ Petition is dismissed. There shall be no order as to costs. Miscellaneous petitions, if any,

pending shall stand closed.
