THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.9613 of 2021 ORDER:

The petitioners/A-1 and A-4 filed the present Criminal Petition under Sections 437 and 439 of the Code of Criminal Procedure seeking to grant bail to them in Crime No.300 of 2021 of Suryapet II Town Police Station, which was registered for the offences punishable under Sections 420, 273 and 328 of IPC and Section 59 of Food Safety and Standard Act, 2006. Heard the learned counsel for the petitioners/A-1 and A-4, the learned Public Prosecutor representing the respondent-State and perused the record.

The petitioners herein are A-1 and A-4 in Crime No.300 of 2021 of Suryapet II Town Police Station. The allegations against the petitioners herein and others are that they are manufacturing and selling adulterated tea products. This Court vide order dated 09-12-2021 granted interim anticipatory bail in respect of A-2 and A-3 on certain conditions.

The petitioners herein were arrested on 22-11-2021.

Learned Public Prosecutor, on instructions, would submit that the Investigating Officer has completed investigation and F.S.L. report is awaited.

In view of the same, according to this Court the petitioners / A-1 and A-4 are entitled for regular bail. The Criminal Petition is allowed and the petitioners/ A-1 and A-4 are directed to be released on bail, subject to the following terms and conditions:

(i) The petitioners/ A-1 and A-4 shall be released on bail on their executing a personal bond to the tune of Rs.20,000/- (Rupees twenty thousands only) each with two sureties for a like sum each to the satisfaction of the Prl. Judicial Magistrate of First Class, Suryapet, Nalgonda District;

(ii) That the petitioners/A-1 and A-4 shall cooperate with the investigating agency. (iii) That the petitioners/A-1 and A-4 shall not misuse the liberty granted to him.

(iv) That the petitioners/A-1 and A-4 shall appear before the Investigating Officer personally once in every fortnight till completion of investigation and filing of final report.

As a sequel, miscellaneous petitions, if any, pending in the criminal petition shall stand dismissed.
