THE HON'BLE SRI JUSTICE SANJAY KUMAR AND THE HON'BLE SRI JUSTICE M. SEETHARAMA MURTI WRIT PETITION No.26889 of 2016 ORDER: (Per Hon'ble Sri Justice Sanjay Kumar) There was no representation for the petitioner when this matter was taken up for hearing on 24.08.2016 and it was accordingly directed to be posted under the caption 'For Dismissal' on 31.08.2016. Today, the matter appears under the said caption but there is no representation for the petitioner or his learned counsel. The prayer in the writ petition was for a Writ of Habeas Corpus directing the Station House Officer, Golconda Police Station, to produce the petitioner's two sons, Azizul Adil Qureshi and Nasrullah Arfat Qureshi, and his driver, Mohd. Akram, and set them at liberty. According to the petitioner, the police subjected the aforestated three persons to illegal custody on 05.08.2016.
While so, the Inspector of Police, Golconda Police Station, Hyderabad, filed a counter-affidavit stating that the alleged first detenu was shown as A2 in Crime No.258 of 2016 registered under Sections 384 and 507 IPC read with Section 109 IPC on the file of Golconda Police Station. He is stated to have been arrested in connection with this crime on 09.08.2016 and remanded to judicial custody by the learned XVII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad, on the same day. He is stated to be presently lodged in Central Prison, Chanchalguda, Hyderabad. As regards the alleged detenus 2 and 3, the Inspector stated that neither of them was wanted in any crime pending investigation by the police authorities of Golconda Police Station and as such the police authorities had no occasion to apprehend them either on the alleged date or any subsequent date. In the light of the aforestated facts and as there is no representation for the petitioner despite the matter appearing under the
caption 'For Dismissal', the writ petition is dismissed for nonprosecution. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
