THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.22346 OF 2016 ORDER:
Heard the learned Counsel for the petitioner and the learned Government Pleader for Home. With consent of the counsel appearing for both parties, the present Writ Petition is disposed of at the admission stage.
2. Since this Court is not adjudicating the matter on merits, hearing of the unofficial respondent may not be necessary.
3. The present Writ Petition is filed with the following prayer: "to issue a writ of Mandamus or any other appropriate writ, order or direction declaring the action of the respondents, especially respondents 3 and 4 in interfering with the personal liberty of the petitioner and summoning him to the police station at the instance of the 5th respondent, without there being any cause or case or reason as illegal, arbitrary and unjust and consequently, direct respondents 3 and 4 not to summon the petitioner to the police station without there being any complaint or case against him and also without following the procedure contemplated under law."
4. The grievance of the petitioner appears to be that respondents 3 and 4 are illegally and intentionally calling the petitioner to the police station without there being any crime registered against him.
5. Learned Government Pleader for Home submits that allegations made in the writ petition are all false and if the petitioner is to be summoned to the police station, respondents will follow the due process of law.
6. Having regard to the above, the Writ Petition is disposed of directing the respondents-police not to summon the petitioner to the police station except in accordance with law. Needless to mention that the respondents shall follow the due process of law while arresting the petitioner in the event of a crime being registered against him.
Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
