M/S Sri Lakshmi Prasanna Agro Paper Industries Limited v. The Eastern Power Distribution Company Limited,

WRIT PETITION No.16715 of 2012 ORDER:

Heard Sri N.Shiva Reddy for petitioner and Sri M.Ravindra for respondents.

The petitioner challenges Proceedings No.SE/O/RJY/DET/AE-T2/F.BB/D.No.388/12, dated 30-04-2012 as illegal, arbitrary and unjust. The subject matter of the writ petition relates to service connection No.RJY-749/HT Category-IA at Polamuru Village, Anaparthi Mandal, East Godavar District. Through impugned proceedings, the respondents imposed penalty for failure of consumer to segregate the consumption of fans and lights with HT consumption.

At the time of hearing, it is submitted that the petitioner in fact has paid Rs.3,35,000/- and the balance payable as on date is Rs.1,35,908/-.

Counsel for petitioner without getting into the merits of the writ petition requests the Court to permit the petitioner to pay balance amount within a reasonable period.

Having regard to totality of circumstances, I am satisfied that the writ petition can be disposed of by giving three months time to the petitioner from the date of receipt of a copy of this order to clear the balance penalty amount levied by respondents. The interim order granted in the writ petition shall continue till expiry of three months period.

Accordingly, the writ petition is disposed of as indicated above. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
