When the matter is taken up for hearing, learned Government Pleader for Medical and Health, appearing for respondent Nos.1 and 2, has informed the Court that the present Writ Petition is filed aggrieved by the interlocutory order of the Tribunal in not granting any interim relief to the petitioner and the learned Government Pleader has also drawn attention of this Court that the Writ Petition is filed aggrieved by the action of the Tribunal in not granting any interim relief and the main O.A. itself is pending. As admittedly, the Writ Petition is filed against the interlocutory order of the Tribunal, the cause in the Writ Petition does not survive as the petitioner can pursue his remedies in the main O.A. which has been transferred to this Court and is pending.
AKS,J & PK,J WP No.11571 of 2012 In view of the said submission, this Court is of the view that the cause in the Writ Petition does not survive and the Writ Petition is liable to be dismissed.
