O R D E R

Sri Ch. Ravi Kumar, learned counsel representing Sri T.M.K. Chaitanya, learned

counsel for the petitioner, states on instructions that the petitioner wishes to avail the appellate remedy provided to him under the statute. As several factual aspects are involved, including the communication of a 'No Objection Certificate' by the Tahsildar, Devarapalli Mandal, to the Assistant Director of Mines and Geology, Laxminarayana Nagar, Anakapalli, Visakhapatnam, this Court is inclined to grant leave to the petitioner though the matter has been pending on the file of this Court for nearly seven years. As this Court granted interim stay of all further proceedings as regards the grant of a quarry lease in respect of Sy.No.1 of Sambavanipalem Village, Devarapalli Mandal, Visakhapatnam, by the order dated 05.08.2009 passed in W.P.M.P.No.38016 of 2008 in W.P.No.

29090 of 2008, the said order shall continue to be operative for a period of four weeks from today. It shall be open to the petitioner to avail the appellate remedy in accordance with law during this period and seek interim protection from the appellate authority pending disposal of the appeal, if it is found to be maintainable.
