Heard.

2. The petitioner seeks to gift Flat No.A on the 5th floor admeasuring 936 square feet in Velmatree Plaza located in Survey No.14/3 of Tiruchanoor Village, Padmavathi Puram Residential area, Tirupati Rural Mandal, Chittoor District, to her daughter. The title of the land is a Riotwari patta granted by the Inam Deputy Tahsildar, Chittoor District, in S.R.91/85, IDT.No.1/1983CTR, dated 31.07.1985, in favour of one G. Shiva Shankara Rao and several registered transactions are relied upon.

3. The present writ petition is, however, filed alleging that when the petitioner approached the third respondent, he declined to receive and entertain the document presented by him for registration with regard to the subject property.

4. The issue raised in this writ petition is squarely covered by the judgment of this Court in W.P.No.16909 of 2015, dated 15.06.2015.

5. In view of the same, following the aforesaid judgment, this Writ Petition is also disposed of directing the 3rd respondent to receive and process the document presented by the petitioner for registration in relation to the subject property. In the event the 3rd respondent is of the opinion that the document warrants refusal of registration, he shall pass appropriate orders duly recording the reasons for such refusal in accordance with Section 71 of the Registration Act, 1908. If, however, the document is found to be complied with all legal requirements, he shall register the same and release it in accordance

with due procedure. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. __________________________ JUSTICE VILAS V.AFZULPURKAR 22nd December, 2015 KL
