THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.194 OF 2015 ORDER:
Heard learned counsel for the petitioner, learned Government Pleader for Land Acquisition appearing for respondents 1 and 3 and learned Government Pleader for Revenue appearing for respondents 2 and 4.
The petitioner is the owner of Acs.3.30 guntas of land in Survey No.838/2/AA situated at Seetharampuram Village, Peddapadu, Yedulla Bayyaram Gram Panchayat, Pinapaka Revenue Mandal, Khammam District. The petitioner apprehends that the land may be taken over for the purpose of construction of a power plant by the respondents without following due process of law.
Learned Government Pleader appearing for the respondents assures that if the respondents require the petitioner's land for the purpose of establishment of a power plant, they will follow the procedure contemplated under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 and that if the respondents are of the opinion that the petitioner is under occupation of the Government land, then they will follow due process of law to dispossess the petitioner from the subject land.
Having regard to the said submissions, the Writ Petition is disposed of directing the respondents to follow due process of law
to evict the petitioner from the subject land. There shall be no order as to costs.
Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
