THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION.No.11742 of 2012 ORDER:

Heard Mr. M. Sapathagiri for petitioner; Mr. Sadhu Rajeshwar Reddy for respondent No.4 and Mr. R. Vinod Reddy for respondents 1 to 3.

2. The subject matter of the writ petition is the electricity connection bearing No.D8-7109 for the shop being No.12-2-822/1/6/A (P) of premises bearing No. 12-2-822/1/7 at Mehdipatnam.

The petitioner complains disconnection of power supply by respondent No.3 without putting the petitioner on notice. It is not in dispute the status of petitioner is that of a tenant of premises bearing No.12-2-822/1/6/A (P). Respondent No.4 is admittedly the owner of the premises.

3. This Court granted interim order on 24.04.2012. Counsel appearing for the parties admit that the interim order is complied with and the connection is restored and the petitioner is at present enjoying the energy supplied by respondents 1 to 3.

The grievance of the fourth respondent is that the connection obtained by the petitioner is based on fabricated documents and by creating artificial documents and such misrepresentation ought not to have been accepted by the third respondent.

Learned standing counsel from the material available on record submits that the third respondent, on being prima facie satisfied about the nature of documents filed by the petitioner would have sanctioned the subject meter. Being the landlord, if the fourth respondent wishes the department to look into the very sanction of meter, it is open to the fourth respondent to file representation with documents and third respondent will consider and after hearing both parties,

pass appropriate orders. Hence, I am satisfied the writ petition can be disposed of by this order.

5. The fourth respondent is given liberty to represent by enclosing a copy of this order, together with exhibits in support of his grievance against the sanction of meter, to the third respondent within four (4) weeks from the date of receipt of a copy of this order.

The third respondent is directed to issue notice to the petitioner as well as the fourth respondent, look into the matter and pass final orders positively within a further period of four (4) weeks from the date of receipt of representation. Interim order dated 24.04.2012 is directed to be maintained for a period of twelve (12) weeks from today.

The writ petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
