This criminal petition is filed, seeking for quash of the proceedings in M.C.No.12 of 2011 under Section 111 of the Criminal Procedure Code, against the petitioners, on the file of the Sub Divisional Magistrate, Vijayawada dated 03.11.2011 issued under Section 107 Cr.P.C.

Heard the counsel for the petitioners and the learned Public Prosecutor, appearing for the respondent.

The impugned order is issued in the following circumstances: Everyday a number of sand lorries carry sand from Didugu and Popuru sand quarries to various places. The respondents i.e. petitioners herein stopped the said lorries and demanded to run on their weigh bridge and got unloaded the excess load of sand and selling the same unauthorizedly through other lorries. When the lorry drivers questioned the petitioners herein about their acts, they came on the road, stopped the lorries and created panic atmosphere. This is happening everyday and there is obstruction for free flow of traffic and inconvenience to public. Since the acts are disturbing the public tranquillity and causing breach of peace in Chintalapadu and surrounding villages, the said order was issued. 4.

The counsel for the petitioners has not been able to make out any ground, which would warrant this Court to set aside the said order.

The learned Public Prosecutor, on the other hand, submits that the order would expire automatically after lapse of one year i.e. on 03.11.2012.

Hence, recording the said submission, the criminal petition is disposed of. As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
