THE HONOURABLE SRI JUSTICE K.LAKSHMAN CRIMINAL PETITION No.9691 OF 2021 ORDER:

This Criminal Petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C'), is filed by the petitioner/Accused No.4 for grant of anticipatory bail in the event of his arrest in connection with Crime No.164 of 2021 of Humayunnagar Police Station, Hyderabad, registered for the offence punishable under Section 370 I.P.C and Sections 3, 4 and 5 of the Prevention of Immoral Traffic Act, 1956. 2.

Heard learned counsel for the petitioner/Accused No.4 and the learned Additional Public Prosecutor representing the respondent/State. Perused the record.

It is brought to the notice of this Court that accused No.5 in the subject crime had filed anticipatory bail vide Crl.P.No.8882 of 2021 before this Court and this Court vide order, dated 07.12.2021 disposed of the said application directing the Investigating Officer to follow the procedure laid under Section 41A Cr.P.C and the guidelines formulated by the Hon'ble Apex Court in Arnesh Kumar v. State of Bihar1.

The petitioner herein, who is accused No.4, is also similarly situated and is entitled for the same order. Therefore, the Investigating Officer in Crime No.164 of 2021 of Humayunnagar, Hyderabad, is directed to follow the procedure laid down under Section 41-A Cr.P.C. and also the guidelines formulated by the Hon'ble Apex Court in Arnesh Kumar's Case.

The

petitioner/accused No.4 shall cooperate with the Investigating Officer.

With the above direction, this Criminal Petition is disposed of.
