THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10552 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by petitioner/Accused No.1 seeking anticipatory bail in the event of his arrest in connection with P.R.C No.144 of 2022 on the file of the I Addl. Junior Civil Judge-cum-XII Metropolitan Magistrate at Rajendranagar. , registered for the offences punishable under Sections 147, 148, 302, 307, 120-B, 448, 427 r/w 149 of Indian Penal Code (for short 'IPC').

Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the respondent-State and perused the record.

Learned counsel appearing for the petitioner would submit that the parties have compromised.

Learned Additional Public Prosecutor on instructions would submit that the parties have entered into a compromise. 5.

Keeping in view that the matrimonial disputes among spouses resulting in charge sheet being filed, this Court deems it appropriate to grant anticipatory bail, subject to the following conditions:

1) The petitioner/Accused No.1 is directed to surrender before the concerned Court on or before 15.11.2023 and file application for recalling warrants which are pending according to the learned counsel for the petitioner.

2) Upon such application being made, the warrant shall be recalled on condition of the petitioner/accused No.4 executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

3) In the event of the failure of the petitioner/accused No.1 to surrender before the concerned Court on the specified date, the police are at liberty to take further course of action.

4) The petitioner/Accused No.1 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C. 5.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
