W.P.No.20702 of 2015 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
"To pass an order, direction or a writ particularly in the nature of Writ of Mandamus declaring that the action on part of the respondent No. 3 in harassing the petitioners by way of calling them to the police station and threatening them of dire consequences for settlement of false civil claim of the respondent No. 4, is illegal, arbitrary and against the directions of this Court. Consequently, this Court may be pleased to direct the respondents not to harass the petitioners by way of threatening them or calling them to the police station for settlement of any civil claims, unless a crime is registered against them".
2. Heard Sri Mohd. Adnan, learned counsel for the petitioners and learned Government Pleader for Home, appearing for respondents 1 to 3, apart from perusing the material available on record.
3. Today, when the matter is called, written instructions dated 13.7.2015 furnished by the Sub-Inspector of Police, Kurnool II Town Police Station have been placed on record by the learned Government Pleader for Home. In the said written instructions, it is stated as under: "In this regard, it is respectfully submitted that no complaint was received in person or by any other means in the name of the 4th respondent against the petitioners in Kurnool-II Town P.S. so far. Further, the petitioners were not involved for any offence and they are not required by Kurnool II Town P.S. It is respectfully submitted that the Station House Officer, Kurnool II Town P.S. is never interfere with any civil claims between the petitioner and the 4th respondent and no body police personnel were called the petitioners to the police station so far, for which this respondent has nothing to do with it. Hence the writ petition deserves no consideration".
4. On noticing the same, the learned counsel for the petitioner requested this Court to close the writ petition by recording the said written instructions.
5. In view of the above reasons, the writ petition is disposed of, by recording the written instructions dated 13.7.2015 furnished by the Sub-Inspector of Police, Kurnool II Town Police Station. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
