THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.10491 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioner - accused No.15 seeking anticipatory bail in the event of his arrest in connection with Crime No.169 of 2023 on the file of Station House Officer, Noothankal Police Station, Suryapet District. The offences alleged against the petitioner are under Sections 143, 147, 148 and 324 read with Section 149 of the Indian Penal Code.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for respondent - State and perused the record.

The Police Noothankal registered two FIRs bearing Nos.168 and 169 of 2023. The said crimes were registered when two groups clashed and attacked one another. 13 persons were mentioned in Crime No.168 of 2023 and 16 persons were mentioned in Crime No.169 of 2023. Petitioner herein is shown as accused No.15 in Crime No.169 of 2023.

It is contented by learned counsel for the petitioner that this Court vide order dated 16.10.2023 in Crl.P.No.10198 of 2023 filed by accused Nos.14 and 16 in Crime No.169 of 2023 has granted regular bail. It is contended by learned counsel for the petitioner that the petitioner herein is accused No.15, therefore, he prayed to grant similar relief in respect of the petitioner - accused No.15 also. 5.

In view of the order dated 16.10.2023 passed by this Court in Crl.P.No.10198 of 2023, this Court deems it appropriate to enlarge the petitioner on bail in the event of his arrest, subject to the following conditions:

i) The petitioner - accused No.15 is directed to surrender before the Noothankal Police Station, Suryapet District, on or before 30.10.2023. On such surrender, the said Station House Officer shall release the petitioner on bail, on his executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each to his satisfaction.

ii) On such release, the petitioner - accused No.15 shall appear before the concerned Station House Officer on every Monday

Crl.P.No.10491_2023 between 10.30 AM and 01.00 PM for a period of four (04) weeks for the purpose of investigation and thereafter, as and when required. iii) Further, the petitioner- accused No.15 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall cooperate with the Investigating Officer in investigating the case. 6.

With the above directions, this Criminal Petition is allowed. Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
