THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.24304 of 2005 ORDER:
Heard the learned counsel for the petitioner and perused the material available on record.
The alleged inaction on the part of respondent Nos.1 and 2 in furnishing the claim application for claiming the insured amount of one late Smt. A. Suseela, an account holder in the Abhaya Gold Scheme in the 2nd respondent - Bank is the grievance in the present writ petition. According to the petitioner, he is the adopted son of late Smt. A. Rangamma, mother of late Smt. A. Suseela, who retired as Child Development Project Officer and who showed her mother late Smt. Rangamma as her nominee in all her service records, including the account held by her in the 2nd respondent Bank. It is stated that the said Suseela and her husband died issueless. It is further stated that Smt. Suseela died at Warangal Railway Station on 28.09.2003 and subsequently on 02.04.2004 her mother, Smt.
Rangamma also died, leaving the petitioner herein as the sole surviving legal heir. It is also stated that the petitioner made a representation to the 2nd respondent bringing to its notice about the death of Smt. Suseela and sought release of the insured amount in his favour and that the 2nd respondent Bank on 02.07.
with a request to send the application directly to the petitioner under intimation to the 2nd respondent office. It is the precise grievance of the petitioner in the present writ petition that though the 2nd respondent addressed the said letter as long back as on 02.07.2004 and though he submitted his representation on 31.08.2004, till date no action has been taken by the 1st respondent and in view of the said inaction, the petitioner is sustaining irreparable loss and injury.
This Court, in its considered opinion, does not find any valid justification on the part of the 1st respondent in not responding on the letter, dated 02.07.2004, addressed by the 2nd respondent and on the representation said to have been made by the petitioner on 31.08.2004.
For the aforesaid reasons, the writ petition is disposed of directing the 1st respondent to take necessary action pursuant to the letter, dated 02.07.2004, addressed by the 2nd respondent vide Lr.No.352/11/190 and the representation of the petitioner, dated 31.08.2004, within a period of three months from the date of receipt of a copy of this order.
Miscellaneous petitions, if any, shall also stand disposed of. There shall be no order as to costs. __________________ A.V.SESHA SAI, J Date: 20.06.2017 ES
