THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.23224 of 2016 ORDER:
This Writ Petition is filed complaining against the 3rd respondent in not taking action against the 4th respondent on the complaint lodged by the petitioner on 10.06.2016.
2. In the said complaint, the petitioner alleged that the 4th respondent had trespassed into the petitioner's land in survey No.266 and was doing illegal mining and other illegal activities in the petitioner's land.
3. In my considered opinion, this is purely a civil dispute and the petitioner has an effective alternative remedy before the competent Civil Court. Therefore, I am not inclined to entertain this Writ Petition.
4. Accordingly, this Writ Petition is dismissed granting liberty to the petitioner to avail appropriate remedy in the competent Civil Court. There shall be no order as to costs.
5. Consequently, miscellaneous petitions pending, if any, shall stand closed.
