THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.926 of 2017 ORDER:

The grievance of the petitioner is with respect to the proposal to grant bar license in favour of the 5th respondent. Petitioner had submitted objections on 27.12.2016 followed by representations dated 03.01.2017 and 21.01.2017. On earlier occasion also when the 5th respondent sought to set up a Bar and Restaurant on the State High Way i.e., Arsapalli Main Road, he filed W.P.No.44341 of 2016, wherein stay was granted. As the 5th respondent was forced to shift the Bar, now he is proposing to set up bar and restaurant in another locality, which is predominantly a residential area and also there is no adequate parking. Bar license cannot be granted without there being adequate parking, is the contention of the learned counsel for the petitioner.

On the other hand, learned Government Pleader submits that the 5th respondent has already been granted 2-B Bar license. The respondent authorities shall furnish a copy of the license granted in favour of the 5th respondent to the petitioner. So far as this writ petition is concerned, as the prayer has become infructuous, the same is dismissed as infructuous giving liberty to the petitioner to challenge the license, which is said to have been granted in favour of the 5th respondent. No costs. Consequently, the Miscellaneous Petitions, if any pending, shall stand closed.
