THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2304 of 2016 ORDER:
This criminal petition, under Section 482 of the Code of Criminal Procedure, is filed by the petitioners seeking to quash the proceedings against them in Crime No.107 of 2013 on the file of Kosgi Police Station, Mahabubnagar District.
Heard and perused the material available on record. The allegations against the petitioners are that they helped A1 to take away the victim girl and in their presence and on their instigation, A1 tide Mangalasutram to the victim girl. The truth or otherwise of the above offences can be ascertained during the investigation. Hence, this Court is not inclined to interfere with the investigation. At this stage, learned counsel for the petitioner submitted that the main allegations are against A1 and A2 only and there are no specific allegations against the present petitioners and in view of the pendency of the above crime, the petitioners apprehend arrest and also the harassment in the hands of the police.
In view of the above, the police concerned are directed to complete the investigation without arresting the petitioner and file final report, if any, in accordance with law. The petitioners are directed to appear before the Investigating Agency as and when their presence is required and cooperate with the investigation. With the above directions, the criminal petition is disposed of. Miscellaneous petitions pending in this criminal petition, if any, shall stand closed.
