Mantri Veeraiah v. State Of Andhra Pradesh, Excise Department,
THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.27546 of 2017 ORDER:
In the present writ petition, challenge is to the alleged action on the part of respondent Nos.3 to 5 in not permitting the petitioner to conduct the business in the premises bearing D.Nos.18-36-23 and 18-36-14 and 14/A, 4th Lane, Lanchestar Road, Sankadigunta, Guntur.
In the instant case, the Prohibition and Excise Superintendent, Guntur, issued Form 2B licence in favour of the petitioner on 15.07.2017.
It is submitted by the learned counsel for the petitioner that the said licence granted in favour of the petitioner is still intact and only on the ground that local residents are objecting, the respondent authorities are not permitting the petitioner to carry on the business.
In the considered opinion of this Court, the said action on the part of the official respondents cannot be sustained so long as the licence granted in favour of the petitioner subsists. However, this order will not preclude the respondents from taking action in accordance with law.
With the above observation, the writ petition is disposed of. No order as to costs.
Miscellaneous petitions, if any, shall also stand disposed of. __________________ A.V.SESHA SAI, J Date: 18.08.2017 ES
