It is the case of the petitioners that their father purchased the land to an extent of 15 guntas in Sy.No.92 in the year 1992 by virtue of registered sale deed and same was transferred in favour of his wife Smt. Khairunnissa Begum, as per the proceedings issued by the Tahsildar vide proceedings No.B/6135/07, dated 06.10.2007.

Thereafter, the mother of the petitioners died and now they have become sole and absolute owners of the said land as legal heirs. That without issuing any notice to the petitioners, foundation stone for construction of PG Centre was laid in the subject land. Heard learned counsel for the petitioner as well as learned Assistant Government Pleader for Revenue.

Learned Government Pleader for Revenue produced record showing that since the purchase of the subject land was in violation of the provisions of A.P.Assigned Lands (Prohibition of Transfer) Act, 1977, notices were issued to the father of the petitioners and also the mother of the petitioners and that resumption orders were passed in proceedings No.B/745/2013, dated 18.09.2013. Against the same, the mother of the petitioners filed appeal and the same was also dismissed by the Revenue Divisional Officer by order dated 20.06.2015 and same become final. Thereafter, the said land was handed over to the Palamuru University, Mahabubnagar, on 04.07.2015 under cover of panchanama.

The petitioners have suppressed the material facts i.e., proceedings initiated against their father and also their mother, dismissal of appeal preferred by their mother, and allotment of subject land to the Palamuru University, Mahabubnagar for construction of PG centre under cover panchanama dated 08.07.2015 and writ petition is

liable to be dismissed for suppression of facts. The resumption order passed has become final.

In view of above facts and circumstances, I do not see any merit in the writ petition and the same is liable to be dismissed. Accordingly, this writ petition is dismissed. There shall be no order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in this writ petition shall stand dismissed. _______________________ A.RAJASHEKER REDDY, J 08.06.2016.
