THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.7425 of 2016 ORDER:

This Criminal Petition is filed by the petitioner-accused seeking to relax the condition imposed against the petitioner in order, dated 26.11.2015, in Crl.M.P. No.1996 of 2015, by the VIII Additional District & Sessions Judge, Vijayawada.

Heard and perused the material available on record. The petitioner is accused in Crime No.620 of 2015 on the file of Machavaram Police Station, Krishna District, for the offences punishable under Sections 420 and 409 r/w.34 IPC and 7 of Essential Commodities Act and 65 and 66 D of Information Technology Act. She approached the Court below for grant of anticipatory bail by filing Crl.M.P.No.1996 of 2015. The Court below granted anticipatory bail to the petitioner vide impugned order. The learned District Judge imposed a condition on the petitioner to attend before the SHO, Machavaram PS., on every Friday until the investigation is completed and cooperate with the Investigating Officer in respect of investigation. To relax the said condition, the petitioner filed the present application.

Learned counsel for the petitioner submitted that the petitioner is complying with the above condition, imposed by the Court below, regularly and the investigation is already completed and charge sheet is yet to be filed and that the petitioner being a housewife, could not able to attend the police station, and hence, the above condition may be relaxed.

Learned Public Prosecutor opposed the application by submitting that the investigation is not yet completed. Considering the facts and circumstances of the case and also taking into consideration that the petitioner is a lady, the condition imposed against the petitioner i.e., to attend before the SHO,

Machavaram Police Station on every Friday until the investigation is completed, in Crl.M.P. No.1996 of 2015, by the VIII Additional District & Sessions Judge, Vijayawada, is hereby relaxed. Accordingly, the Criminal Petition is allowed. Miscellaneous petitions pending if any, shall stand closed. ______________ RAJA ELANGO, J June 09, 2016.
