ORDER:

This Writ Petition is filed for a Mandamus to declare the action of the respondents in seizing 170 quintals of rice in 680 bags, each containing 25 kgs, along with lorry bearing registration No.AP 21W 3037 as illegal and arbitrary.

A perusal of the record shows that the abovementioned stock along with the lorry was seized under a panchanama, dated 08.3.2009, wherein it is stated that a case under Section 6-A of the Essential Commodities Act, 1955 (for short 'the Act') is registered.

Though the Writ Petition has been pending for six years, no counter-affidavit is filed and no information as to whether such proceedings, if initiated, were concluded or not is not forthcoming. However, as the respondents

have to take the seizure to its logical end, it is reasonable to presume that the case was disposed of in view of long lapse of time.

On this premise, the Writ Petition is disposed of as infructuous.

As a sequel to disposal of the Writ Petition, WPMP.No.8222 of 2009 shall stand disposed of as infructuous.
