ORDER

Heard learned counsel for the petitioner, learned Government Pleader for Panchayat Raj and Rural Development, learned Government Pleader for Revenue and Sri P. Raghavender Reddy, learned Standing Counsel for respondent No.5 and Sri M.S.R.Chandra Murthy, learned Standing Counsel for respondents 4 and 6.

2. The petitioner, who was working as Field Assistant, was found to have committed some irregularities in the Employment Guarantee Scheme and consequently, he was removed by the order of the Project Director dated 14.10.2014. Aggrieved thereby, the petitioner preferred an appeal before the third respondentDistrict Collector on 02.01.2015. Petitioner also states that out of the amount of Rs.8,677/- found to be not accounted for by him, he has already remitted part of the amount without prejudice to his appeal and he is willing to deposit the balance amount also. However, the present writ petition is filed on the allegation that while the appeal is pending, some other Field Officer is sought to be appointed in the place of the petitioner and thereby, even if the petitioner succeeds in the appeal, he would be put to prejudice.

3. Since the petitioner's appeal is pending before the competent authority, the intervention by this Court at this stage is not called for and it would in the interest of justice to dispose of

the writ petition by directing the third respondent to consider the petitioner's appeal and take appropriate decision in the matter after notice to the petitioner, preferably, within two months from the date of receipt of a copy of this order.

4. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
