THE HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No. 5622 OF 2015 ORDER:
This Writ Petition is filed to declare the action of the respondent in interfering with the peaceful possession and enjoyment of the commercial building of the petitioner consisting of ground, first and second floors bearing D.No. 23/997, Trunk Road, Opp: R.T.C. Bus Stand, Nellore Town, S.P.S.R. Nellore District, by giving marking on the said building for demolition for the purpose of road widening without issuing any notice and without following due process of law as illegal and arbitrary. 2.
This Court by order dated 06-03-2015 directed both parties to maintain status quo. No counter affidavit has been filed by the respondent corporation.

Heard learned counsel for the petitioner.

As the grievance of the petitioner is that the respondent is trying to demolish his commercial building without any notice whatsoever, the respondent is directed to issue notice and follow due procedure contemplated under law before taking any further action.

The Writ Petition is disposed of accordingly. Pending miscellaneous petitions, if any, shall stand closed in consequence.
