The writ petition is filed questioning the action of the respondents in not extending the benefit of absorption/regularisation in the category of Junior Plant Attendant with effect from 6.12.1996.

Learned counsel for the petitioner submits that the issue involved in the present writ petition is squarely covered by the common judgment dated 06.11.2014, passed by the Division Bench of this Court in W.A.Nos.404 of 2006 and 492 of 2009 and W.P.Nos.3383, 13318, 13934 and 14136 of 2007. Smt G.

Aruna, learned counsel appearing for the respondents-Genco submits that subsequent to filing of the writ petition, petitioner was given the benefit This Company Petition is filed invoking the provisions of Sections 433(e), 434(1)(a) and 439 1(b) of the Companies Act, 1956, alleging the inability of the respondent-company to pay the debt.

Learned counsel for the petitioner submits that his client does not wish to prosecute the matter any further and seeks permission of this Court to withdraw the company petition. Permission is accorded.

Accordingly, the Company Petition is closed. No order as to costs.
