HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE Dr. JUSTICE SHAMEEM AKTHER WRIT APPEAL No.485 OF 2017 JUDGMENT: (Per Hon'ble The Acting Chief Justice Ramesh Ranganathan) After arguing for some time, Sri Vedula Venkata Ramana, learned Senior Counsel, appearing on behalf of the respondent-writ petitioner, would submit that, instead of adjudicating the order under appeal on merits, it would suffice if this Court were to set-aside the order under appeal, and permit the petitioner to avail the remedy of an Appeal to the appellate authority.
Sri O. Manohar Reddy, learned counsel for the appellantrespondent, has no objection to such an order being passed. The order under Appeal is set-aside, leaving it open to the respondent-writ petitioner to avail the remedy of an appeal. The Writ Appeal is disposed of accordingly.
