THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.11300 OF 2001 ORDER:

This writ petition is filed by the petitioner challenging the award passed by the 1st respondent in Miscellaneous Petition No.9 of 1999 in I.D.No.12 of 1998, dated 28.6.2000 only to the extent of denial of backwages and continuity of service.

Heard Sri S.M. Subhan, learned Counsel for the petitioner and Sri A. Rama Rao, learned Standing Counsel for APSRTC. 3.
It has been contended by the learned Counsel for the petitioner that the petitioner was removed from service on 20.5.1999 on the allegation of theft and that the General Secretary, APSRTC, National Mazdoor Union has exposed the case of the petitioner by filing M.P.No.9 of 1999 before the 1st respondent-Tribunal and that the 1st respondent-Tribunal by award dated 28.6.2000 directed the APSRTC to reinstate the petitioner into service as driver on the last pay drawn, within 30 days from the date of publication of the award, and that the 1st respondent-Tribunal further held that the petitioner is not entitled to any backwages and continuity of service except for terminal benefits and hence, the petitioner approached this Court.

The learned Standing Counsel appearing for respondents Nos.2 and 3 submitted that the petitioner was reinstated into service in compliance with the orders passed by the 1st respondent-Tribunal and that the 1st respondent-Tribunal had rightly denied the backwages and continuity of
service and that the award impugned does not warrant any interference by this Court.

Perused the records and heard the arguments made by both the Counsel. Having agreed with reasoning recorded by the 1st respondentTribunal for denying backwages and continuity of service except terminal benefits, I do not see any illegality in the award passed by the 1st respondent-Tribunal. This petition is devoid of merits. 6.
Accordingly, the Writ Petition is dismissed. No costs. Consequently, miscellaneous petitions pending, if any, shall stand dismissed. _____________________________ (ABHINAND KUMAR SHAVILI, J) 23rd November, 2017 Nn
