HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.41194 of 2016 O R D E R :
The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ or order, more particularly one in the nature of writ of Certiorari calling for the records pertaining to C.C. No.286 of 2006 on the file of the IX Metropolitan Magistrate, C.Cr.C. at Hyderabad and quash the same in so far as petitioners are concerned. Heard the learned counsel for petitioners and the learned Assistant Government Pleader for Home and perused the material available on record. The petitioners herein are challenging the charge-sheet filed against them.
The Court is of the view that when petitioners have any such grievance, they can file a petition for discharge before the Court concerned and on such application being made, the trial Court is directed to consider the same and pass appropriate orders.
Further, considering the nature of allegations against the petitioners, presence of the petitioners on each and every hearing before the trial Court is dispensed with, but they shall appear before the trial Court when the trial Court insists for their appearance for any specific purpose.
