THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5432 OF 2015 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.2 seeking grant of anticipatory bail in connection with crime No.233 of 2015 on the file of the P.S., Chilakalaguda, registered for the offences under Sections 307 IPC and Section 25(1)(A) of the Indian Arms Act.

Heard.

The case of the prosecution is that when the de facto complainant went into his car to go home from his shop, all of a sudden, A.3 and A.4 entered into the car and aimed pistal to the de facto complainant and that A.3 and A.4 admitted to have committed the offence along with A.1 and A.2 and they were engaged by A.1 to kill the complainant since there is enmity among them in connection with their business transactions.

Learned counsel for the petitioner/A.2 submits that the petitioner has not committed the offence alleged against him and false case has been foisted against the petitioner. He further submits that the petitioner is a law abiding citizen and is ready to comply with any of the conditions that may be imposed while granting anticipatory bail.

On perusing the complaint and the order of the Court in dismissing the bail application filed by the petitioner, this Court is of the view that it is not a fit case to grant anticipatory bail.
