THE HON'BLE SRI JUSTICE RAJA ELANGO TRANSFER CRIMINAL PETITION No.171 of 2012 ORDER:

This petition is filed by the petitioner seeking to transfer C.C.No.446 of 2011 pending on the file of the II Additional Judicial Magistrate of First Class, Tenali, Guntur District to the Judicial First Class Magistrate, Sullurpet, Nellore District. Heard and perused the material available on record. The 2nd respondent, who is the daughter-in-law of the petitioner filed a complaint against the petitioner and her son for the offence punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act and after completion of the investigation, the police filed the charge sheet against the petitioner and her son before the learned Magistrate, Tenali and the same was numbered as C.C.No.446 of 2011.

The ground raised by the petitioner for transfer of the case is that the 2nd respondent engaged some persons to kill the son of the petitioner and they killed the son of the petitioner and after the murder of the son of the petitioner, the men of the 2nd respondent used to threaten the petitioner over phone to transfer the property of the petitioner in favour of the 2nd respondent and they also proclaimed that whenever the petitioner attends the case at Tenali, they will see her end.

Considering the facts and circumstances of the case and the grounds raised by the petitioner, this Court is inclined to transfer the above C.C., pending on the file of the II Additional Judicial Magistrate of First Class, Tenali, Guntur District to the Court of the Additional Judicial Magistrate of First Class, Ongole concerned. Accordingly, the Transfer Criminal Petition is disposed of. Consequently, the miscellaneous petitions, if any pending in this petition, shall stand closed.
