THE HONOURABLE SRI JUSTICE K. LAKSHMAN CRIMINAL PETITION No.9633 of 2021 ORDER:

The petitioners / A-1 and A-2 filed the present Criminal Petition under Sections 437 and 439 of the Code of Criminal Procedure seeking to grant bail to them in Crime No.309 of 2021 of Bhadrachalam Town Police Station, which was registered for the offence punishable under Section 8 (c) r/w. 20(b) N.D.P.S. Act.

Heard the learned counsel for the petitioners/A-1 and A-2, the learned Public Prosecutor representing the respondent-State and perused the record.

The allegations against the petitioners herein are that they are transporting 112 Kgs., of Ganja and they were arrested on 25-07-2021.

Learned Public Prosecutor, on instructions, would submit that there is no case other than this case against the petitioners herein and the Investigating Officer has completed investigation and F.S.L. report is awaited.

In view of the same, according to this Court the petitioners / A-1 and A-2 are entitled for regular bail.

The Criminal Petition is allowed and the petitioners/ A-1 and A-2 are directed to be released on bail, subject to the following terms and conditions:

(i) The petitioners/ A-1 and A-2 shall be released on bail on their executing a personal bond to the tune of Rs.20,000/- (Rupees twenty thousands only) each with two sureties for a like sum each to the satisfaction of the Judicial Magistrate of First Class, Bhadrachalam;

(ii) That the petitioners/A-1 and A-2 shall cooperate with the investigating agency. (iii) That the petitioners/A-1 and A-2 shall not misuse the liberty granted to him.

(iv) That the petitioners/A-1 and A-2 shall appear before the Investigating Officer personally on every Sunday between 10.00 AM and 5.00 PM till completion of investigation and filing of final report.

As a sequel, miscellaneous petitions, if any, pending in the criminal petition shall stand dismissed.
