HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 5646 of 2010 Order:

The petitioner claims to be a businessman and also a Member of the State Executive Committee of Bharatiya Janata Party. He contested in the Legislative Assembly Elections from Kothapet Constituency, East Godavari District. Though he is not a habitual offender, when a rowdy sheet was opened against him, he filed the present Writ petition challenging the same.

2. Learned Government Pleader, on the basis of written instructions, submits that the petitioner used to make groups and promote enmity among different sections in Ravulapalem village. He also makes real estate settlements and extracts money from the innocent persons. He was involved in Crime No.68 of 2003 of Ravulapalem Police Station and was convicted and sentenced to pay a fine of Rs.1,000/- on 05.07.2008. He was also involved in Crime No.166 of 2008, but the same was referred as false on 03.11.2008. Similarly, Crime No.75 of 2009 also referred as false on 30.05.2009. He is at present facing the trial in CC No.450 of 2009 on the file of the Judicial Magistrate of First Class, Kothapet in respect of Crime No.115 of 2009. In view of the involvement of the petitioner in the above crimes, a rowdy sheet was opened on 07.12.2009 and it is being continued from time to time. It was last extended till 02.12.2016.

3. The above facts show that the petitioner is at present facing trial only in CC No.450 of 2009 before the Judicial Magistrate of First Class, Kothapet.

The Police Standing Orders do not allow continuance of rowdy sheet, when the petitioner was involved only in one case.

4. In the circumstances, the first respondent is directed to review the case of the petitioner, consider the same in accordance with the AP Police Standing Orders and pass appropriate orders on the

continuance of the rowdy sheet, within a period of three (3) months from the date of receipt of a copy of this order.

5. The Writ Petition is, accordingly, disposed of. However, in the circumstances, no costs.

6. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
