THE HON'BLE SMT JUSTI CE KONGARA VI JAYA LAKSHMI Writ Petition No.23760 of 2007 Order:

This Writ Petition is filed to declare the notice dated 22.11.2006 and final orders dated 02.03.2007 issued by the 2nd respondent - Mandal Revenue officer, Tupran Mandal, Medak District, resuming the land of the petitioners admeasuring Ac.5-00, forming part of Survey Nos.342/30, 342/36 and 342/60 (old Survey No.342/30/2/AA), situated at Muppireddypally village and Grampanchayat, Tupran Mandal, Medak District, as illegal and arbitrary.

Today, when the matter is taken up for hearing, learned counsel for the petitioners submits that challenging the very same proceedings, the petitioners have filed W.P.No.20271 of 2007 and this Court, by orders dated 06.11.2014, allowed the said writ petition and, in that view of the matter, nothing survives for adjudication in the present Writ Petition and the matter has become infructuous. He also filed copy of order dated 06.11.2014 passed in W.P.No.20271 of 2007.

Recording the said submission made by the learned counsel for the petitioners, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
