THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.25385 of 2011 ORDER:
The grievance of the petitioner in this case was that the police authorities were not taking necessary action in Crime No.30 of 2011 on the file of the Machilipatnam Town Police Station, Machilipatnam, Krishna District.
The Station House Officer, Machilipatnam Police Station, Krishna District, furnished written instructions dated 10.06.2015 to the office of the learned Government Pleader for Home wherein he stated that upon the private complaint made by the petitioner, the learned II Additional First Class Magistrate, Machilipatnam, forwarded the same to the Machilipatnam Town Police Station and thereupon, Crime No.30 of 2011 was registered under Sections 120-B, 192, 205, 415, 420, 463, 465, 467 and 503 I.P.C. However, investigation revealed that the dispute was purely civil in nature. Accordingly, a final report to that effect was filed before the competent Court which was recorded in C.R.F.No.7500/2011 dated 14.11.2011.
In the light of the aforestated developments, the grievance of the petitioner as to the alleged inaction on the part of the police authorities is shown to be without basis. In the event the petitioner is aggrieved by the conclusion arrived at by the police authorities, it is for him to avail appropriate remedies in accordance with law. Reserving liberty to the petitioner to do so, the writ petition is dismissed.
Pending Miscellaneous Petitions shall also stand dismissed. No order as to costs.
