THE HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.2 and 3 of 2019 In/and CRIMINAL PETITION No.8620 of 2019 ORDER:

This Criminal Petition, under Section 482 of Cr.P.C., is filed by the petitioners/accused Nos.1 and 2 seeking to quash the proceedings against them in S.C.No.257 of 2018 on the file of Sessions Court for trial of SC & ST, Ranga Reddy District at L.B.Nagar.

During pendency of the Criminal Petition, I.A.No.2 of 2019 came to be filed by the petitioners/accused Nos.1 and 2 to compound the offences in the aforesaid Sessions Case. In the affidavit filed in support of the said petition, it is stated that basing on the complaint of the 2nd respondent-de facto complainant, the police Peddemul has registered a case in Crime No.55 of against the petitioners/accused Nos.1 and 2, for the offences punishable under Sections 420, 504 and 506 read with 109 I.PC and Section 3 (1) (r) (s) of the SC/ST (POA) Act, 2015; that after due investigation, the police filed charge sheet before the Sessions Court for trial of SC/ST, Ranga Reddy District at L.B.Nagar, and the Court has taken cognizance of the case and numbered as S.C.No.257 of 2018 and the same is pending.

During pendency of the said case, the matter has been carried to the elders and well-wishers of both parties and on the advise of the elders, the petitioners and 2nd respondent have settled the matter out of the Court and the settlement is that the petitioners shall not purchase the land of the 2nd respondent. 3.

I.A.No.3 of 2019 came to be filed by the 2nd respondent-de facto complainant, wherein it is stated that during pendency of the case,

the matter has been settled out of the Court and the petitioners have agreed not to purchase of the land of the 2nd respondent and as such the 2nd respondent agreed to withdraw the case registered against the petitioners and the petitioners also agreed for compromise. 4.

Today, both parties are present in-person before this Court and filed photographs and Photostat copies of Aadhar Cards in proof of their identity. Along with petitions, a Joint Compromise Memo, which is signed by both parties and their counsel has been filed, wherein it is stated that at the intervention of elders and wellwishers, the parties have settled their disputes and the 2nd respondent/de facto complainant has no objection if the proceedings are quashed against the petitioners/accused Nos.1 and 2 in the afore-stated Sessions Case.

In the light of the compromise arrived at between the parties, the joint memo filed by the both parties is taken on record and I.A.Nos.2 and 3 of 2019 are ordered.

Consequently, the Criminal Petition is allowed in terms of compromise, and the proceedings in S.C.No.257 of 2018 pending on the file of Sessions Court for trial of SC/ST, Ranga Reddy District at L.B.Nagar, are hereby quashed against the petitioners/accused Nos.1 and 2.
