M/S.Sri Sai Ram Enterprises v. The Southern Power Distribution Company Of Telangana State Ltd

Since the issue involved in these writ petitions is one and the same, these writ petitions are heard together and disposed of, by way of this common order.

It has been contended by the petitioners that they are having disputes with Indian Drugs and Pharmaceuticals Limited (IDPL) regarding their plot and that they have pursued their remedies before the competent Civil Court and the competent Civil Court had passed a decree in their favour. Thereafter, they have intended to establish a electrical wiring and fitting manufacturing unit in their plot and accordingly they have applied for service connection. But the respondents are not sanctioning the service connection to their plot. Aggrieved by the same, the present writ petition is filed. Learned counsel for the petitioners contends that at the instance of IDPL, the respondents are not sanctioning the service connection to the petitioners' plot. He further contends that when similar issue was raised in respect of M/s.Sri Sai Traders, M/s.

Durga Industries and M/s.Rajugari Industries and others, the respondents have granted service connection in favour of the said firms but when it comes to petitioners, the respondents are illegally denying the same. Therefore he contends that appropriate orders be passed directing the respondents to consider the case of the petitioners on par with similarly situated firms in whose favour service connection was granted.

Learned Standing counsel appearing for the respondents had contended that since IDPL raised objections, the case of the

petitioners would be considered and appropriate orders would be passed, if only petitioners submit a fresh representation. This Court, having considered the rival submissions of both the parties, is of the considered view that this writ petition can be disposed of directing the petitioners to submit a fresh representation staking their claim for grant of service connection on par with M/s.Sri Sai Traders, M/s.Durga Industries and M/s.Rajugari Industries and others, within a period of two weeks from the date of receipt of a copy of this order and upon such representation being received, the respondents shall consider the same and pass appropriate orders in accordance with law, in another eight (08) weeks thereafter.

With the above direction, these writ petitions are disposed of. No order as to costs.

Pending miscellaneous applications, if any, shall stand closed in consequence.
