THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA Writ Petition No. 20545 of 2006 Order: (Per the Hon'ble The Acting Chief Justice Ramesh Ranganathan) Sri S.D. Gowd, learned Standing Counsel for the Municipal Corporation, states that the Commercial Tax Department has been entrusted with the power of collecting Entertainment Tax, the Municipal Corporation is no longer insisting on payment of Entertainment Tax by the cable operators, and the impugned notices would not be acted upon by the Municipal Corporation. In view of the submission now made by Sri S.D. Gowd, learned Standing Counsel for the Municipal Corporation, the impugned demand notices are set aside. Needless to state that this order shall not preclude the Commercial Tax Department, if they are so entitled, from recovering the Entertainment Tax dues in accordance with law.

The writ petition is, accordingly, disposed of.

The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
