THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.12421 OF 2012 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:

"to issue a writ or order or direction more particularly one in the nature of Writ of Mandamus declaring action of the respondent No.2 in filing the charge sheet in Crime No.212 of 2011 of Bheemili Police Station, Visakhapatnam for offences punishable under sections 304-A and 201 IPC and Section 134 (A) & (B), 196 of M.V. Act instead of 302 IPC is illegal, arbitrary and in violation of principles of natural justice and consequently direct the 1st respondent to reinvestigate into the case in Crime No.212 of 2011 of Bheemili Police Station, Visakhapatnam with any other investigation officer at Visakhapatnam and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."

2. When the matter is called, it is represented by learned counsel for the petitioner that the petitioner herein may be permitted to make necessary application before the Court below for redressal of his grievance. This Court considers the said request as reasonable and the same is not opposed by the learned Government Pleader.

3. For the aforesaid reasons, Writ Petition stands disposed of, keeping it open for the petitioner herein to make necessary application before the Court below for redressal of his grievance.
